What is the " Trademark+" announcement (2023 edition)?

The Ministry of Business and Made in Italy, in collaboration with the General Directorate for the Protection of Industrial Property – Italian Patent and Trademark Office and Unioncamere, has launched a support initiative called “Marchi+”.

This is not a completely new facilitation, but the replication of a project that has already made it possible for Italian companies to recover, with percentages ranging from 80 percent to 90 percent, the investments incurred to design and register their trademarks both at the European and international level.

This joint effort aims to provide indispensable support to micro, small and medium-sized enterprises (MSMEs) in the delicate task of protecting European Union and international trademarks, in order to establish and maintain the competitiveness of Italian companies in the global market.

Who are the potential beneficiaries of the Call for Proposals?

Beneficiaries of the facilities under the “Trademarks +” Call for Proposals are enterprises that meet the following requirements:

  • They must be micro, small or medium-sized enterprises, including sole proprietorships;
  • They must have registered and operational headquarters in Italy;
  • They must be duly incorporated and registered in the Register of Enterprises;
  • They must not be in a state of liquidation, dissolution or subject to bankruptcy proceedings;
  • They must be in good standing with their contribution obligations;
  • They must not have grounds for prohibition related to anti-mafia regulations;
  • They must not have pending administrative proceedings for undue receipt of public resources;
  • They must own the trademark that is the subject of the application.

Since when can the application be submitted?

The application can be filed from November 21, 2023. Participants must own the trademark by that date, and the trademark must have been filed or registered after January 01, 2020. For European trademarks, registration must be with EUIPO; for international trademarks, filing or registration must be with WIPO. In addition to these specific rules, there are other general requirements to be met.

Is there a deadline to submit the application, how does the "click day" work?

The click day of “Trademarks+” edition 2023, set for 9:30 a.m. on November 21, is the crucial date for application submission. There is no fixed deadline, but the application can be submitted until the available resources, which amount to only two million euros, are exhausted.

It is therefore crucial that the registration and all necessary documentation be ready and in order by that date, as resources are allocated according to a counter evaluation procedure and in chronological order of submission.

There are no rankings. What is the maximum contribution amount?

A company may submit multiple applications for facilitation, for both Measure A (European trademarks) and Measure B (international trademarks), up to a total value of €25,000.00. The amount is subject to the limitations provided for each individual trademark and type of service. In the case of a European trademark subsequently extended internationally, the company may submit a single application to request both Measure A and Measure B, always subject to the overall limit of €25,000.

What are the new features of the 2023 edition?

The 2023 edition has some key changes from previous editions, including:

  • Application mode: new rules articulated in Article 7 of the Notice;
  • Trademark filing: required to have taken place since January 01, 2020, as stated in Article 3 of the Notice;
  • Regularisation of invoices: mandatory affixing of the Unique Project Code (CUP), art. 7 of the Notice.

What are the types of expenditures that can be subsidized?

Eligible expenses are limited to a maximum of €25,000.00 per enterprise, with different categories and specific limits for each type of investment.

Measure A (80 percent of expenses):

Design: € 1,500.00
Assistance for filing: € 300.00
Priority searches: € 1,500.00
Legal assistance: € 1,500.00
Filing fees: 80%.

Measure B (90% of expenses):

Design: € 1,650.00
Filing assistance: € 350.00
Prior art searches: € 1,800.00
Legal assistance: € 1,800.00
Registration fees: 90%.
